Prohibited Sharing of Accounts
EHR Tutor student accounts are sold on a per user basis and each paid license grants access to only one specific original user.
- Sharing of a student account with another student is strictly forbidden and may result of the removal or deletion of the shared account.
- The transfer of a paid account from the original user to another user is strictly forbidden and may result of the removal or deletion of the transferred account.
Assessment Technologies Institute, LLC is not to be held responsible in any way for removal or deletion of a student account for the reasons listed above.
You agree that you will not upload, post, or otherwise distribute or publish through EHR Tutor any text, data, or other information that Assessment Technologies Institute, LLC deems to be or do the following:
- Designed to obtain unauthorized access to any information
- Threatening, abusive, degrading, sexually indecent, libelous, defamatory, harassing, tortious, racially, ethnically or otherwise objectionable
- Constitute or encourage conduct that would violate law or create civil liability
- Intentionally contain a virus or other harmful component designed to interrupt, destroy or limit the functionality of any computer software or hardware or any communications equipment
Protected Health Information
All identifiers associated with Protected Health Information(PHI) as interpreted by the U.S. Health Insurance Portability and Accountability Act(HIPAA) is absolutely prohibited from entry or inclusion in EHR Tutor for real patients! Only fictitious patient identifiers are allowed. Real identifiers must never be entered into EHR Tutor for the following:
- Patient names
- Any part of patient addresses
- Dates, including birth date, admission date, discharge date, date of death
- Phone numbers
- Email addresses or any type of Internet identifier
- Social Security numbers
- Medical record numbers
- Health plan beneficiary numbers
- Account numbers
- Full face images or biometric identifiers
- Any other unique number, characteristic or code identifying a real person
Assessment Technologies Institute, LLC reserves the right to remove any content that, in its sole discretion, does not comply with the foregoing content restrictions or is otherwise harmful or objectionable. Assessment Technologies Institute, LLC is not to be held responsible in any way for removing such content.
Assessment Technologies Institute, LLC owns intellectual property rights in EHR Tutor. EHR Tutor is protected by copyright laws, as well as laws and treaties related to other forms of intellectual property. Except as expressly authorized by Assessment Technologies Institute, LLC, you agree not to rent, lease, loan or sell EHR Tutor services or the related software, in whole or in part. In addition the organization, graphics, design, compilation, magnetic translation, digital conversion and other matters related to the EHR Tutor website and the services provided by EHR Tutor are protected under applicable proprietary rights including, but not limited to, intellectual property.
Disclaimer of Warranties
Assessment Technologies Institute, LLC makes no warranties, to the fullest extent permitted by the law, express or implied, in fact or in law, including, but not limited to, any implied warranties of merchantability or fitness for a particular purpose. Assessment Technologies Institute, LLC make no warranty that EHR Tutor will meet your requirements or operate under your specific conditions of use. Assessment Technologies Institute, LLC makes no warranty that operation of EHR Tutor will always be error free, uninterrupted, or free of viruses or other harmful components, or that the possibility of a security breach can never occur.
Limitation of Liability
You expressly understand and agree that Assessment Technologies Institute, LLC, its members, employees or agents will not be liable for any direct, indirect, incidental, special, or consequential damages, including, but not limited to, damages for loss of revenue, goodwill, use, data, or other intangible losses resulting from the use or inability to use any of EHR Tutor services. This limitation of liability pertains to losses resulting from alteration or destruction of your user accounts, content or data, or any other matter relating to the use of EHR Tutor. This limitation of liability applies if the alleged liability is based on contract, tort, negligence, strict liability or any other basis, even if Assessment Technologies Institute, LLC has been advised of the possibility of such damage. The foregoing limitation of liability will apply to the fullest extent permitted by law in the applicable jurisdiction.
Accuracy of Information Disclaimer
Information presented on, or accessed through, EHR Tutor may contain inaccuracies or errors. It is solely the user’s responsibility to evaluate the accuracy, completeness, reliability, and validity of all information presented on, or accessed through, EHR Tutor.
Some content of EHR Tutor includes health or medical related information. Such content is provided to support a simulated electronic charting experience and should never be relied on for actual medication administration, or as a medical diagnosis, or treatment for any real person. Assessment Technologies Institute, LLC disclaims any liability for information of any kind, presented on, or accessed through EHR Tutor for any loss, damage or injury of any kind incurred as a result of the use of, or reliance on, such health or medical information.
You will indemnify, defend and hold harmless Assessment Technologies Institute, LLC and any of its members, employees or agents from and against any and all claims, actions, proceedings, suits, liabilities, damages, settlements, penalties, fines, losses, or expenses, including attorneys’ fees, costs and disbursements arising out of, or in any way connected with, your use of EHR Tutor.
Governing Law and Jurisdiction
This Agreement is governed by the laws of the state of Ohio and is within the jurisdiction of the state of Ohio.
If any provision of this Agreement shall be held to be invalid or unenforceable, the remainder of this Agreement shall remain in full force and effect. To the extent any express or implied restrictions are not permitted by applicable laws, these express or implied restrictions shall remain in force and effect to the maximum extent permitted by such applicable laws.
